SUBJECT: Citrus County Temporary Fireworks Sales Event Selection Process ORIGINATING DEPARTMENT: Growth Management

POLICY:

In recognition of the Florida Statute restriction on the annual number of temporary fireworks sales facilities, Citrus County desires to provide a fair and equitable process to select the permit applicant sites for each year while giving preference to local businesses. 

PROCEDURE:

  1. On or before October 1 of each calendar year, except that on or before November 1, 2018, for the 2019 calendar year, an applicant for inclusion in the selection process for permits for the upcoming period of December 10th through January 2nd, or from June 20th through July 5th (following calendar year) must provide an application packet that contains the following information for each proposed site and each proposed timeframe:
    • Location of proposed site for temporary sales facility, and dates requested.
    • List of all products to be sold.
    • If tent is proposed, acknowledgement that tent approval will be obtained from the Building Division prior to each event.
    • A copy of the business’ Business Tax Receipt issued by Citrus County, (if the applicant is a Citrus County business
  2. The Land Development Division Director or designee will place a number on each of the completed applications, and a corresponding number will be placed into the selection container. On the date of the drawing for the upcoming calendar year, a random number will be drawn by the Land Development Division Director or designee, until a total of ten applications have been drawn for both time periods. The same or related business entities, as identified by a Federal Tax ID number, cannot submit more than five (5) applications for this drawing.
  3. If the applicant holds a Citrus County Business Tax Receipt, the applicant will be given local preference in the selection drawing by the local applicants being eligible for a drawing for the first five (5) permits before the remainder of the applicant's numbers being entered into the drawing. The result will be that the pool of local applicants will hold the first five (5) permits and the remaining five (5) permits will be issued through the normal drawing process.
  4. Any unassigned permits after the October 1st drawing may be assigned by the Land Development Division Director or designee on a first-come, first-serve basis. Permits assigned via the selection process shall not be transferable and shall only be used by the applicant.
  5. Within thirty (30) days after selection, the selected applicant(s) must apply for and obtain a temporary event permit for fireworks sales, including any applicable tent documentation and appropriate review fees. If the temporary event permit is not obtained within 30 days after selection, that event approval will be considered as withdrawn and the event approval may be assigned to a subsequent applicant.

FOOTNOTES & REFERENCES TO RELATED AR’s: As of the date of adoption of this A.R., F.S. 791.07 prohibits new permanent fireworks retail sites, and limits the number of temporary retail sales of fireworks to the number of permits issued by the County during the 2006 calendar year.
